Homegrown Cannabis Laws And Restrictions In Mississippi

Until the 2020 elections, Mississippi was a state devoid of weed – medical or otherwise. The first time someone was caught in possession of smaller amounts of marijuana (30 grams or less) was at least decriminalized, so it could have been worse – but possession of 30 or more grams was a felony.
There were no specific laws against growing marijuana, but they fell under possession or sale. Marijuana sales, in any amount, was a felony with around 3 years of jail time for the lowest offense and a $3,000 fine.
Worse yet, Mississippi enacted a mandatory minimum sentence for some marijuana-related charges. That means a judge would have no option to reduce jail time, instead sentencing them to a minimum number of years in prison. Worse yet, this often negated any chance for getting out on parole, making marijuana-related crimes especially devastating.
While many of those past laws are still true, Mississippi now has a medical marijuana program. Mississippi voters decided with a resounding "yes" to approve Initiative 65. Under it, patients can access the medical marijuana they need. Unfortunately, this program will likely not be operational until the end of 2021. It is all a matter of when the program details are organized to the point that dispensaries are ready to provide medicine to their patients.

Unfortunately, growing marijuana, even for patients, remains illegal, but that too can change by contacting Mississippi state representatives and lobbying for free and fair home grow laws. At a Pot for Pot, we always advocate for peoples’ right to grow their own clean medicine at home.

Q: Is growing marijuana now legal for residents of Mississippi?
A: Sadly, no. Even a registered patient in the medical marijuana program cannot grow their own cannabis plants anywhere in Mississippi. There is no plan to change this any time soon.

A: Currently, 22 conditions qualify patients for the medical marijuana program. These conditions are:

Cachexia

Epilepsy or another seizure disorder
Huntington's disease
Severe muscle spasticity
Sickle-cell anemia
Cancer
Agitation of dementias
Spinal cord disease or major injury
Autism, if it includes qualifying behaviors such as aggression or self-injuries
Crohn's disease
ALS
Muscular dystrophy
Intractable nausea
Pain refractory to appropriate opioid management
Glaucoma
Parkinson's disease
Ulcerative colitis
Chronic or debilitating pain
Other conditions that a physician recommends medical marijuana for when the benefits of using it outweigh potential health risks

A: Patient applications will start being accepted in the summer of 2021 and will begin being issued as early as August 15th.
